Jiaquan IP Ranger Note:
A geographical indication application requires more than proof of origin or local reputation.
The CNIPA’s guidance on trademark refusal review highlights seven core evidentiary elements for GI collective and certification marks in China.
Applicants should establish:
• qualified applicant status
• authority to apply for and administer the GI mark
• supervision and testing capacity
• a clearly defined production area
• the specific quality of the goods
• a causal link between that quality and local natural or human factors
• reputation and procedural compliance for international registrations
The key is not only to show where the goods come from, but also to explain why that geographical environment gives the goods their distinctive qualities.
