Beijing Internet Court annual report

Deputy Party Secretary and Vice President Zhao, Ruigang first reported on personal information and data privacy cases. From October 2023 to October 2024, the Beijing Internet Court accepted 113 cases of personal information protection disputes and concluded 104 cases. Research indicates that most infringing parties in these cases are internet companies with diverse types of personal information. The primary issues concern the right to be informed and decide regarding personal information. Based on the main characteristics of these cases, there is tension between personal information protection and the reasonable use of data. The types of personal information rights holders seek to protect are increasingly varied. New infringement cases, such as those involving "AI face-swapping" and other AI technologies, continue to emerge. Case hearings have revealed the following issues in balancing personal information protection and reasonable data use:



  1. Individuals' awareness and capability to protect personal information in diverse online scenarios need improvement.
  2. Failure to fulfill their legal obligations has led to information security risks for personal information handlers.
  3. Regulatory agencies need to enhance enforcement measures and risk warning systems further.


In response, the Beijing Internet Court suggests increasing public awareness and capacity for protecting personal information, enforcing the protection obligations and responsibilities of personal information handlers, and strengthening the security and regulation of personal information.
